ISD Dynamics Terms of Service

1. Acceptance of Terms

By accessing or using the ISD Dynamics website (the "Site") and services provided by ISD Dynamics, operating under the trademark of intellismartdigital ("we," "our," "us," or "the Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Site or our services.

These Terms constitute a legally binding agreement between you and ISD Dynamics. We reserve the right to update these Terms at any time. ISD Dynamics provides AI consulting, workflow automation, custom SaaS development, data analytics, intelligent chatbot development, and system integration services (collectively, "Services"). The specific scope, deliverables, timelines, and fees for any engagement are defined in a separate service agreement or statement of work ("SOW") executed between you and ISD Dynamics.

3. Eligibility

You must be at least 18 years of age to use our Site and Services. By using the Site, you represent and warrant that you have the legal capacity to enter into a binding agreement and that you are not prohibited from using the Site under any applicable law.

4. User Obligations

When using our Site and Services, you agree to:

For client engagements, intellectual property ownership and licensing terms are governed by the applicable service agreement or SOW.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of an engagement. Confidential information includes, but is not limited to, business strategies, technical specifications, financial data, and client data. This obligation survives the termination of any agreement between the parties.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

• ISD Dynamics provides the Site and its content on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
• We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
• In no event shall ISD Dynamics, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services.
• Our total aggregate liability for any claims arising from these Terms or your use of the Site shall not exceed the amounts paid by you to ISD Dynamics in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless ISD Dynamics, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
